BLOCKBUSTER® Blu-ray® Days Sweepstakes OFFICIAL RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. The BLOCKBUSTER Blu-Ray Days Sweepstakes (the "Sweepstakes") begins on April 27, 2009 and ends on May 8, 2009. Each day during the Sweepstakes, Blockbuster will ask a movie-themed question at 2 p.m. CST on its Twitter feed at http://twitter.com/blockbuster_com. The first person to respond back with the correct answer will win the prize for that day. Odds of winning depend on whether you are the first person to respond with the correct answer, as determined by Blockbuster in its sole discretion. The prizes shall vary from day to day and may include a BLOCKBUSTER GiftCard®, a free subscription to the BLOCKBUSTER Online® subscription service or a Blu-ray DVD, with the prize on May 8, 2009 being a Sylvania NB501SL9 Blu-ray player (with an approximate retail value of $199.99). Limit one (1) entry per person per day and limit one (1) prize per person during the Sweepstakes. Entry requires signing up for a Twitter account through twitter.com. There is currently no charge for a Twitter account. Blockbuster Inc. has no control over the data practices and data collection of Twitter. The Sweepstakes is sponsored by Blockbuster Inc., 1201 Elm Street, Dallas, Texas 75270 ("Sponsor").

ELIGIBILITY.

 The Sweepstakes is open to all legal residents of the fifty (50) United States and the District of Columbia, who as of 2/1/09 are 18 years or older. Persons who on or after 1/1/09 are or were employees, officers, directors, agents and representatives of Sponsor, its participating retailers, and members of the immediate family (defined as mother, father, sister, brother, daughter, son or spouse, regardless of where they live) and those living in the same household of each (whether or not related), are not eligible to enter. All entries are subject to review and verification by Sponsor whose decisions are final, binding and conclusive in all matters relating to the Sweepstakes. By entering the Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of the Sponsor. The Sweepstakes is void where prohibited by law.

LIABILITY/GENERAL RULES.

 Sponsor is NOT responsible for any computer, telephone, cable, satellite, network, technical, electronic or hardware/software malfunctions, connections, failures, availability, traffic congestion, unauthorized human intervention, or technical, electronic or mechanical computer error of non-transmitted automatic entries. Sponsor is NOT responsible for any incorrect or inaccurate information, whether caused by tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes. In the event that the Sweepstakes is incapable of running as originally planned due to computer virus, bug, tampering, technical failure or other cause beyond the control of Sponsor, Sponsor reserves the right to terminate the Sweepstakes. Prize cannot be substituted or converted to cash by winner. Sponsor reserves the right to substitute a prize of equal or greater value at its option, including Sponsor's right to substitute should the featured prize become unavailable for any reason. All federal, state and local taxes imposed on the prize are the sole responsibility of the winner. Sponsor reserves the right to disqualify entrants who fail to follow these Official Rules and regulations or who make any misrepresentations relative to the Sweepstakes and redemption of the prize.

Each Winner grants permission to Sponsor to use its name, address, and/or photographs for publicity purposes (including posting on-line), without additional compensation or permission, except where prohibited by law. Sponsor, its participating retailers, affiliates, subsidiaries, franchisees, suppliers, distributors and each of their respective officers, directors, employees, shareholders, representatives and agents are NOT responsible for any negligence, claims, liability, injury, property loss or other damages of entrants and/or winners arising from, or in connection with the acceptance, receipt, possession or use/misuse of the prize awarded or participation in the Sweepstakes. Sweepstakes subject to applicable federal, state and local laws and regulations.

Winner of the Blu-ray player prize may be required to execute and return within five (5) days of receipt an Affidavit of Eligibility and Release of Liability and, except where prohibited, a Publicity Release, certifying eligibility and compliance with these Official Rules, agreement to hold Sponsor, its participating retailers, affiliates, subsidiaries, franchisees, suppliers, distributors and the officers, directors, employees, shareholders, representatives and agents of each harmless from any liability arising from participation in the Sweepstakes or the acceptance, receipt, possession or use/misuse of prize. The signature of the potential winner on the affidavit must be witnessed by a person 18 years of age or older and the witness must sign the affidavit. If the winner is a minor, the prize will be awarded in the name of the winner's parent or legal guardian. Noncompliance by potential winner may result in disqualification and forfeiture of prize. Any prize notification returned as undeliverable will result in disqualification and an alternate winner may be selected.

ARBITRATION/CHOICE OF LAW.

 Except where prohibited by law, as a condition of participating in the Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes), and participant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Texas, USA without regard to choice of law rules.

CONDITIONS.

 Winner waives the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem said prize and any liability which might arise from redeeming or seeking to redeem said prize.
