Membership and Use

You must be a BLOCKBUSTER member to purchase a Total Access In-Store membership. The Total Access In-Store membership you purchase is your "Total Access In-Store Membership" and your regular BLOCKBUSTER membership is your "account" or your "BLOCKBUSTER account." For a monthly Total Access In-Store Membership fee (plus applicable taxes), you can rent up to a certain number of movies at any one time (as explained below). The amount of the Total Access In-Store Membership fee will vary depending on the number of rentals you select when you purchase the Total Access In-Store Membership, and may also be different from store to store and may be changed from time to time. Your Total Access In-Store Membership can only be used at the participating BLOCKBUSTER store where you purchased the Total Access In-Store Membership. Your Total Access In-Store Membership can only be used on one BLOCKBUSTER account, and is nontransferable. Your Total Access In-Store Membership starts on the day you buy it, and automatically renews every month (as explained below) until you cancel or until we can no longer charge the monthly Total Access In-Store Membership fee to the credit card or check card* (the "Payment Card") you've given us (the "Total Access In-Store Membership Term"). By using your Total Access In-Store Membership, you acknowledge that we've given you a copy of these Terms and Conditions and that you've read and agree to them.

The Total Access In-Store Membership you purchase allows you to rent up to a predetermined number of movies on your Total Access In-Store Membership, for no additional charge other than your monthly Total Access In-Store Membership fee, so long as the movie rentals are returned to the store location where they were rented before the expiration of the Total Access In-Store Membership Term. The movies you rent on your Total Access In-Store Membership are your "Total Access In-Store Rentals." The number of Total Access In-Store Rentals you can have out at any time depends on the Total Access In-Store Membership you buy-for example, your store may offer an option to have out one, two, or three movies at a time, or something else. The available options may vary from store to store and from time to time. The maximum number of Total Access In-Store Rentals you can have out at any one time is your "Maximum Total Access In-Store Rentals." '

To rent a Total Access In-Store Rental, you must present your BLOCKBUSTER membership card or your government-issued photo ID at the time of rental. You may only rent one (1) copy per title as part of your Total Access In-Store Rentals. Your Total Access In-Store Rentals do not count as paid rentals towards BLOCKBUSTER Rewards® benefits. You can use your Total Access In-Store Membership to rent any movies in the store, but you can't use your Total Access In-Store Membership to rent games, special products such as defensive driving courses, or equipment. Once you've reached your Maximum Total Access In-Store Rentals checked out at any time, no additional movies may be designated as Total Access In-Store Rentals until you return one or more of the Total Access In-Store Rentals. You may rent as many additional movies as you like, but these additional rentals will be subject to the otherwise applicable rental terms (i.e., due dates and times) and membership rules then in effect for the store from which the movies were rented (the "Rental Terms"). These additional rentals also will be subject to all otherwise applicable rental fees and other charges (including extended viewing fees (where applicable), additional daily rental fees (where applicable) and charges for movies not returned by a specified date and time, the rental of which are converted to a sale) (we'll refer to all of those possible fees and charges as the "Fees"). If you are renting Total Access In-Store Rentals and other movie rentals in the same transaction, you must designate which movie rentals you want to be the Total Access In-Store Rentals at the time of rental, and you may not change your designation once the transaction is completed. Total Access In-Store Rentals will be identified as such on your rental receipt.

You may purchase different levels of Total Access In-Store Membership at one time. For example, you may have a one-movie Total Access In-Store Membership and a two-movie Total Access In-Store Membership, if available at your store. However, you can only have one of each level of Total Access In-Store Membership at any time (for example, you can only have one two-movie Total Access In-Store Membership at any given time). If you have multiple rental Total Access In-Store Memberships on your BLOCKBUSTER account (for example, if you have more than one Total Access In-Store Membership, or another type of Total Access In-Store such as a BLOCKBUSTER Flip Card™ that you purchased prior to purchasing your Total Access In-Store Membership), Blockbuster will determine in its sole discretion to which Total Access In-Store the rentals apply. Also, Total Access In-Store Rentals are specific to the particular Total Access In-Store Membership and can't be combined, even if you have multiple Total Access In-Store Memberships.

The rental period for Total Access In-Store Rentals is the Total Access In-Store Membership Term for that Total Access In-Store Membership remaining as of the date of rental. Any Total Access In-Store Rental not returned by the expiration date of the Total Access In-Store Membership Term will immediately be subject to the Rental Terms and applicable Fees upon the expiration of the Total Access In-Store Membership Term. Remember, you can't combine Total Access In-Store Rentals on different Total Access In-Store Memberships. If you have multiple types of Total Access In-Store Memberships, and one expires while another is still valid, you still must return any Total Access In-Store Rentals associated with the expiring Total Access In-Store Membership prior to its expiration or those rentals will be subject to the Rental Terms and applicable Fees, even if you've got less than the Maximum Total Access In-Store Rentals checked out under your non-expiring Total Access In-Store Membership. The only instance in which Total Access In-Store Rentals will automatically transfer to another Total Access In-Store Membership is if you are upgrading or downgrading your Total Access In-Store Membership as discussed below AND if there is no lapse in Total Access In-Store Membership Terms between the two Total Access In-Store Memberships.

Total Access In-Store Rentals may not be used for payment of any other account balance, including any applicable Fees. This offer and Total Access In-Store Rentals are not valid with any other discounts or offers.

How to Buy, Monthly Charge Authorization, Cancellation by Member, and Upgrading/Downgrading

How to buy a Total Access In-Store Membership:

Check Card Payment: At the time you pay the applicable initial Total Access In-Store Membership fee (plus applicable taxes) for the first month's Total Access In-Store Membership, you are agreeing and directing Blockbuster or its agent to automatically renew your Total Access In-Store Membership each month for the applicable membership fee (plus taxes) by charging your Payment Card until your Total Access In-Store Membership is canceled as provided herein. To do so, you must provide to Blockbuster your Payment Card charge authorization information for the Payment Card that you provide for payment of the monthly Total Access In-Store Membership fee. You agree to pay the applicable monthly Total Access In-Store Membership fees (plus applicable taxes) in accordance with your Payment Card issuer agreement. From time to time, Blockbuster may offer a discount on the initial Total Access In-Store Membership fee for a specified promotional period. You agree that any such discount is only valid for the specified promotional period, and that the regular applicable monthly Total Access In-Store Membership fee will be charged to your Payment Card for each automatic renewal.

Monthly Charge Authorization:

By requesting a Total Access In-Store Membership and by accepting the benefits of the Total Access In-Store Membership, you agree that as a condition of your continued Total Access In-Store Membership you authorize Blockbuster or its agent to charge the applicable monthly Total Access In-Store Membership fee (plus applicable taxes) to the Payment Card on the monthly anniversary date of purchase for each consecutive month of Total Access In-Store Membership until your Total Access In-Store Membership is canceled. This continuing charge authorization shall be equivalent to individual signatures by the member on subsequent monthly Payment Card charges or "signature on file" transactions. You will not be provided with copies of charge slips evidencing the recurring charges of the applicable monthly membership fee. You also agree that the amount of applicable taxes may change from time to time, and you authorize any such changed amount to be included in your recurring monthly charge for your Total Access In-Store Membership.

Disclosure to and Electronic Fund Transfer Authorization by Check Card Holders:

Check cards are a form of debit card which cause charges against bank accounts and are subject to federal law. If the Payment Card you have provided is a check card, in order to request Blockbuster to extend your Total Access In-Store Membership Term month to month you must authorize Blockbuster or its agent to charge the check card monthly and therefore to effect preauthorized transfers from the bank account that is associated with your check card. Your request to pay your recurring monthly Total Access In-Store Membership fee (plus applicable taxes) with preauthorized charges to your check card and your written or electronic execution of an acknowledgement of your receipt of these terms and conditions constitutes your preauthorized electronic fund transfer authorization for future charges on your check card and your assent to these terms and conditions. You may cancel your Total Access In-Store Membership at the BLOCKBUSTER store (identified above) where you bought the Total Access In-Store Membership. This cancellation will cancel any check card charge authorization that was to occur on any day after the date of cancellation. No refunds will be made for Total Access In-Store Membership fees already paid or charged. You may also cancel your preauthorized charge authorization by contacting your bank within a sufficient time to cancel the authorization (see your agreement with your bank for the terms and conditions of cancellation), but cancellation of your authorization with your bank will not serve as notice to Blockbuster concerning cancellation of your Total Access In-Store Membership.

Expiration of Payment Card or Other Refusal of Charges:

If the Payment Card is no longer valid, has expired, or for any reason will not accept charges for subsequent monthly Total Access In-Store Membership fees, you have a period of 10 days from the date that your Payment Card was declined to visit the participating store where you purchased your Total Access In-Store Membership and provide new valid Payment Card information. If new valid Payment Card information is provided within the 10-day period and any past due Total Access In-Store Membership fees are paid, then Total Access In-Store Membership benefits will continue uninterrupted and this new Payment Card will be used to charge the applicable monthly Total Access In-Store Membership fee for each consecutive month until your Total Access In-Store Membership is canceled (your original anniversary date will still apply). If you do not provide new valid Payment Card information within the 10-day period, then your Total Access In-Store Membership will expire on either the 11th day from the date your Payment Card was declined or the last day through which your Total Access In-Store Membership was paid, whichever occurs later.

Cancellation by You:

The initial monthly Total Access In-Store Membership fee is valid for an initial Total Access In-Store Membership period starting on the date of purchase and continuing through the same day of the following month. For example, if on June 18 you purchased your Total Access In-Store Membership, your initial Total Access In-Store Membership fee entitles you to Total Access In-Store Membership benefits until July 18 and your Payment Card will be charged on July 18 for the period of July 19 through August 18. You can cancel your Total Access In-Store Membership at any time at the participating store where you bought your Total Access In-Store Membership and you will not be charged for any additional months. There are no refunds for any months (or portions thereof) already billed or paid for. For example, if your purchase anniversary date is the 5th of each month and you cancel your Total Access In-Store Membership on Oct. 20, then you will not be charged on Nov. 5 (for the Nov. 6 - Dec. 5 period) and your Total Access In-Store Membership Term will expire on Nov. 5. However, if you canceled on Oct. 2, then your Total Access In-Store Membership Term would expire Oct. 5. Remember, you must return any Total Access In-Store Rentals rented under your Total Access In-Store Membership by the end of your Total Access In-Store Membership Term (or they will be subject to the Rental Terms and applicable Fees as provided above). You agree that the Total Access In-Store Membership does not involve an extension of credit or a retail installment sale since Blockbuster does not impose a finance charge and you may cancel your Total Access In-Store Membership at any time.

Total Access In-Store Rentals At Time of Cancellation or Expiration:

Total Access In-Store Rentals that are not returned prior to the expiration or cancellation of the applicable Total Access In-Store Membership Term will immediately be subject to the Rental Terms and applicable Fees upon the expiration of the Total Access In-Store Membership Term (unless you are upgrading or downgrading, as noted below). See your store for applicable Rental Terms and Fees.

Upgrading and Downgrading of Total Access In-Store Memberships:

If the store where you bought your Total Access In-Store Membership offers more than one level of Total Access In-Store Membership, you may upgrade or downgrade your Total Access In-Store Membership if there will be no lapse in Membership Term between the two Total Access In-Store Memberships. To upgrade or downgrade your Total Access In-Store Membership, visit the store where you bought your Total Access In-Store Membership and ask to upgrade/downgrade your Total Access In-Store Membership. You will be asked to give your written or electronic authorization to the new recurring monthly charge and pay the applicable monthly Total Access In-Store Membership fee for your new upgraded or downgraded Total Access In-Store Membership for the initial month. By upgrading or downgrading your Total Access In-Store Membership, you are agreeing and directing Blockbuster or its agent to automatically renew your new upgraded or downgraded Total Access In-Store Membership each month for the applicable Total Access In-Store Membership fee (plus taxes) by charging your Payment Card until your upgraded/downgraded Total Access In-Store Membership is canceled as provided herein. Your monthly anniversary date will remain the same; on your next monthly anniversary date, your old Total Access In-Store Membership will expire and your new upgraded/downgraded Total Access In-Store Membership, and new amount of Maximum Total Access In-Store Rentals, will begin. In addition, when you upgrade or downgrade your Total Access In-Store Membership, any outstanding Total Access In-Store Rentals rented on your Total Access In-Store Membership will automatically transfer to your new upgraded or downgraded Total Access In-Store Membership, as long as there is no lapse in Membership Terms between the two Total Access In-Store Memberships. If you've downgraded, you must return any Total Access In-Store Rentals that would exceed the new number of Maximum Total Access In-Store Rentals before the effective date of your new downgraded Total Access In-Store Membership. For example, if you downgrade from a two-movie Total Access In-Store Membership to a one-movie Total Access In-Store Membership, and you have two Total Access In-Store Rentals checked out, you must return one Total Access In-Store Rental before the effective date of your downgrade (which would be your normal monthly anniversary date). If you don't, one Total Access In-Store Rental will immediately be subject to the Rental Terms and applicable Fees upon the effective date of your downgraded Total Access In-Store Membership. Blockbuster will determine in its sole discretion which unreturned Total Access In-Store Rental will no longer be considered a Total Access In-Store Rental and will be subject to the Rental Terms and applicable Fees. If you've upgraded, you can add additional Total Access In-Store Rentals as of the effective date of your upgrade (which would be your normal anniversary date). For example, if you upgrade from a one-movie Total Access In-Store Membership to a two-movie Total Access In-Store Membership, and you have one Total Access In-Store Rental checked out, you may check out one additional Total Access In-Store Rentals on the effective date of your upgrade.

Cancellation or Changes to Total Access In-Store Membership by Blockbuster:

Subject to the next sentence, Blockbuster may change any or all aspects of Total Access In-Store Membership, including the monthly Total Access In-Store Membership fee, the number or composition of permitted Total Access In-Store Rentals, the name of the Total Access In-Store Membership, the applicable Total Access In-Store Membership rules and regulations and special offers regarding the Total Access In-Store Membership, and any other term or condition applicable to Total Access In-Store Membership, at any time, and from time to time, without prior notice. However, Blockbuster will give prior notice at participating BLOCKBUSTER store locations of any change to the Total Access In-Store Membership fee or price or the number or composition of permitted Total Access In-Store Rentals that will adversely affect existing Total Access In-Store members. You agree that, unless you cancel your Total Access In-Store Membership prior to the effective date of the change, you will be charged the new applicable monthly Total Access In-Store Membership fee each subsequent month on and after the effective date of such change. Blockbuster reserves the right to end the Total Access In-Store (including, without limitation, ceasing to offer one or more of the types of Total Access In-Storees) with 30 days prior notice at participating BLOCKBUSTER store locations. This is a limited time in-store offer and is available only at participating BLOCKBUSTER store locations. Void where prohibited.
