The following general terms and conditions are applicable at all corporate-owned BLOCKBUSTER stores in the United States, including the Test Markets.
Movie and Game Rentals: All movie and game rentals are due back at the date and time printed on the transaction receipt. Depending on the BLOCKBUSTER store, there may be an additional rental charge if a member keeps a rental item beyond the initial pre-paid rental period (an "Additional Daily Rate"). If a member chooses to keep a rental item for more than ten (10) days after the end of the initial pre-paid rental period, BLOCKBUSTER will convert the rental to an automatic sale ("AutoSale") and on the eleventh (11th) day after the end of the initial pre-paid rental period, charge the rental item's AutoSale price to the credit card or check card on file or to the membership account, as applicable, subject to the return policy set forth below.
AutoSale Price: The "AutoSale price" means the price, at the time of rental, for either the previously rented product or the new retail product (whichever is lower), as charged by that BLOCKBUSTER store for the product, if the product is available for sale as previously rented product at that BLOCKBUSTER store at the time of rental. If the product is not available for sale as previously rented product at that BLOCKBUSTER store at the time of rental, then the "AutoSale price" will be the new, retail price charged by that BLOCKBUSTER store for the product at the time of rental.
AutoSale Return: If a member returns the product within ten (10) days of the AutoSale, the member will receive a credit back in the amount of the AutoSale price to the credit card or check card on file or the membership account, as applicable. Most stores provide for an extended return window such that if a member returns the product more than ten (10) days following the AutoSale but on or before thirty (30) days following the AutoSale, the member will receive a credit back in the amount of the AutoSale price to the membership account. Product may not be returned after thirty (30) days following the AutoSale in stores that provide for the extended return window. PLEASE NOTE: For all BLOCKBUSTER stores where Additional Daily Rates are charged on movie and/or game rentals, if an AutoSale is reversed by returning the rental item (as described above), the member will be credited back for the AutoSale price, but the member remains responsible for all accrued Additional Daily Rates and the initial rental fee incurred prior to the AutoSale.
For Maryland stores only: Any Additional Daily Rates or AutoSale charges will be charged to the Member's membership account, not a credit or check card.
NOTE ABOUT FRANCHISE LOCATIONS: THE ABOVE STORE RENTAL TERMS AND CONDITIONS MAY NOT APPLY AT FRANCHISEE-OWNED STORES, AND STORE RENTAL TERMS VARY AT FRANCHISE LOCATIONS. A MEMBER IS SUBJECT TO THE TERMS AND CONDITIONS OF THE BLOCKBUSTER FRANCHISE STORE WHERE A RENTAL OCCURRED. SEE IN-STORE LEGAL SIGNAGE AT APPLICABLE BLOCKBUSTER FRANCHISE STORES FOR MORE DETAILS REGARDING THAT FRANCHISE STORE'S SPECIFIC TERMS AND CONDITIONS.
BLOCKBUSTER Direct Access Movie and Game Rentals ("DA Rentals"): To place an order for a DA Rental, you must provide a valid email address and valid delivery address, as well as secure your store membership account with a valid credit or check card (check card must bear the VISA® or MASTERCARD® logo). DA Rentals have a 7-day rental period (the "7-Day Rental Period"), which begins on the day following the "Estimated Arrival Date" printed on the transaction receipt and ends on the "Due Date" printed on the transaction receipt. DA Rentals must be received at either a participating BLOCKBUSTER store or a United States Post Office (if returned by mail) on or before the Due Date. There is no additional rental charge if a member keeps a DA Rental beyond the Due Date. However, if a member chooses to keep a DA Rental for more than ten (10) days after the Due Date, BLOCKBUSTER will convert the rental to an automatic sale ("AutoSale") on the eleventh (11th) day after the Due Date and charge the DA Rental's applicable DA AutoSale price to the credit card or check card on file or to the membership account, as applicable.
DA AutoSale Price: The "DA AutoSale price" shall be $19.99, plus all applicable taxes for BLOCKBUSTER Direct Access Movie Rentals, and $49.95, plus all applicable taxes for BLOCKBUSTER Direct Access Game Rentals.
Estimated Arrival Date: The "Estimated Arrival Date" is calculated according to the chart below. The term of the 7-Day Rental Period begins on the day following the Estimated Arrival Date regardless of the actual delivery date of the DA Rental. This calculation does not take into account federal holidays.

General Terms and Conditions:
Membership in BLOCKBUSTER Rewards is valid for one (1) year from the date of activation and is not transferable. BLOCKBUSTER Rewards membership requires payment of an annual fee, which may vary by location, plus any applicable tax. From time to time, BLOCKBUSTER may offer complimentary or discounted memberships; these Terms and Conditions apply to all such memberships. Void where prohibited by law.
Free Monthly Movie Rentals:BLOCKBUSTER Rewards members receive a coupon for one (1) free movie rental each calendar month during the membership term, for a total of twelve (12) (including the free rental token in the BLOCKBUSTER Rewards membership kit). You receive your first Free Monthly Movie Rental coupon when you join and activate your Blockbuster Rewards card. Your next Free Monthly Movie Rental coupon will be available in approximately four (4) to six (6) weeks. Each month's Free Movie Rental coupon is valid only during the dates indicated on the coupon and is good for a non-New Release movie rental. Excludes all games, Newest Release, and New Release movies. Non-New Release movies are determined by BLOCKBUSTER at its sole discretion and may from time to time be referred to as BLOCKBUSTER FavoritesTM or such other category name as BLOCKBUSTER selects. Coupons may not be reproduced. See Movie Rental coupon for full details and other restrictions.
Earned Free Rentals:For every five (5) full-priced paid movie or game rentals in the calendar month, you'll earn one (1) free movie or game rental, good for any movie or game in the store, up to two (2) per calendar month. For purposes of this earned free rentals benefit (as well as the Midweek Rental benefit described below), paid rentals do not include discounted (including, without limitation, dollars or cents off rental coupons, movie rental cards, pass subscription rentals, BLOCKBUSTER Online® rentals, etc.) or free rentals. Earned free rentals are tracked automatically on your membership account. Paid rentals that count towards the free rental in the calendar month in which the paid rental transactions occurred and may not be applied to the following month's earning period, except that if you purchase your membership on or after the fifteenth of a month you have the remainder of the current month plus all of the following month for your first earning period. Free rentals earned during any calendar month may be redeemed at any participating BLOCKBUSTER store until the end of the following calendar month.
Midweek Rentals:With each full-priced paid movie or game rental Monday through Wednesday at a participating BLOCKBUSTER store, you may rent one (1) non-New Release movie for FREE. Free rental excludes all games and New Release movies. See Earned Free Rentals above for a description of eligible paid rentals. Non-New Release movies are determined by BLOCKBUSTER at its sole discretion and may from time to time be referred to as BLOCKBUSTER Favorites or such other category name as Blockbuster selects. Paid rental and free rental must be taken in the same transaction. There is no limit to the number of Rent 1 Get 1 transactions in any visit.
All Free Rentals (Including Monthly Movie Rental Coupons):Membership rules apply to all free rentals. A member is responsible for applicable taxes and any charges other than the initial rental fee for the free rental. See participating stores for full rental terms and conditions. Free rentals may not be used for defensive driving courses or equipment rentals. Free rentals may only be used for rental transactions during the period the free rental benefit or coupon is valid and may not be used for payment of rental charges placed on membership account. Coupons and other free rental benefits are non-transferable and have no cash value. If customer rents multiple titles when redeeming the Monthly Movie Rental coupon or midweek Rent 1 Get 1 benefit, the free rental credit will be applied to the lowest rental price.
Program Changes and Availability:BLOCKBUSTER may change these terms and conditions or the program rules, regulations and special offers regarding BLOCKBUSTER Rewards at any time without prior notice. BLOCKBUSTER reserves the right to end BLOCKBUSTER Rewards with three (3) months' prior notice. Certain BLOCKBUSTER Rewards promotions and special offers may be unavailable at some locations that otherwise participate in BLOCKBUSTER Rewards.
Participating BLOCKBUSTER stores may offer the BLOCKBUSTER Blue Ticket Pass, the BLOCKBUSTER Movie Pass and the BLOCKBUSTER Kids Pass (each, a "Pass"). The Blue Ticket Pass is good for unlimited movie and game rentals each month with one rental out at a time. The Movie Pass is good for unlimited movie rentals each month with one rental out at a time. The Kids Pass is good for unlimited Kids and Family movie rentals and game rentals ($2.99 or less) each month with one rental out at a time. Any rental day(s) skipped during a month cannot be used later and are forfeited. Membership for the Pass requires a valid credit or check card for payment of monthly fee, plus tax. The Pass automatically renews monthly unless cancelled prior to the renewal date. To cancel the Pass, contact the BLOCKBUSTER store where it was purchased. Pass rentals do not count towards BLOCKBUSTER Rewards benefits. Pass rentals must be returned on or before the expiration of the membership term or charges applicable to non-Pass rentals will begin accruing. The Pass subscription membership can only be used on one membership account and only at the participating BLOCKBUSTER store where it was purchased. If a member rents more than one movie or game in the same transaction, the Pass rental will be applied to the lowest priced rental. Pass rentals are not valid in combination with any other offers or discounts.
Effective 06/01/2010, Blockbuster will no longer accept any type of check (e.g., personal, business, travelers', etc.) as a form of payment in its corporate-owned stores.
Credits are valid for 180 days after issuance, except that prepaid credits and credits for traded product do not expire. Expiration is void where prohibited by law. Credits or refunds are available for returned product (see "Refund and Return Policy"). Credits are automatically applied to any outstanding account balances, then to the next transaction.
BLOCKBUSTER will take reasonable steps to protect Member privacy consistent with the guidelines set forth in this policy and the law. Blockbuster supports the requirements and intent of the Video Privacy Protection Act of 1988 and will require employee compliance with the Act.
Blockbuster LLC ("Blockbuster"), its affiliates and franchisees may use Member information to develop and improve the products, benefits, and services we or selected business partners offer to BLOCKBUSTER Members. Blockbuster will provide its members with the opportunity to make elections with respect to receiving promotional materials, products, or other communications from (1) Blockbuster, including its affiliates and franchisees, or (2) their business partners. Subject to a Member's exercise of such election opportunities, BLOCKBUSTER Membership Terms and Conditions permit Blockbuster, its affiliates and franchisees to release certain membership data such as names, addresses, e-mail addresses, and/or subject matter of video material to their business partners for the exclusive purpose of marketing goods and services directly to members. Blockbuster, its affiliates and franchisees may share and use certain membership data in the ordinary course of their business, including for account maintenance, debt collection and marketing. Under no circumstances will Blockbuster disclose title-specific information to anyone except as allowed by law.
Blockbuster may also disclose personally identifiable information concerning a Member (1) to a Member; (2) pursuant to a law enforcement warrant, criminal or grand jury subpoena, or court order; or (3) in the ordinary course of business, such as (without limitation) debt collection and transfer of ownership.

This video tape service provider from time to time provides to marketers of goods and services, the names and addresses of customers and a description of subject matter of materials rented by video customers. You have the right to elect not to have your name, address, or the description of subject matter of any material rented included in such lists. All disputes between you and BLOCKBUSTER regarding your membership, account, fees, your purchase or use of any goods or services, any transaction with BLOCKBUSTER, or any BLOCKBUSTER policies, shall be resolved by binding individual arbitration under the American Arbitration Association's rules for consumer-related disputes. Neither you nor BLOCKBUSTER will participate in a class action or class-wide arbitration for any claims covered by this agreement. If this class action waiver is found to be unenforceable in a particular case, then this entire arbitration agreement shall be null and void in that case. This agreement shall be governed by the Federal Arbitration Act and, where consistent, Texas law. BLOCKBUSTER reserves the right to change this dispute resolution provision, but any such changes will not apply to disputes filed before the effective date of the amendment. This provision will survive the termination of your BLOCKBUSTER membership.
If the quality of your previously played movie or game is not satisfactory, just return it with your receipt within 30 days to exchange it or get a full refund. Merchandise returned for quality reasons must be in its original packaging as sold by BLOCKBUSTER and must be accompanied by your original receipt from the BLOCKBUSTER store location where it was purchased. Exchange limited to the same previously played movie or game.
Please note that you may be required to purchase other products before you can redeem a rebate. Any questions, ask a customer service representative.
Members may not have more than twenty (20) rental items of any kind checked out at a time. In addition, Members may not have more than five (5) game rentals checked out at a time. Upon reaching either of these limits, Members will not be allowed to rent any additional products (movies or games) until the number of items outstanding falls below the applicable limit. In addition, Members may not rent more than four (4) games in a single transaction.
Purchases of the same DVD, Blu-rayTM or game title, regardless of platform, are limited to five copies per Member and/or account within any consecutive 90-day period. Purchases of game hardware systems, regardless of platform, are limited to five units per Member and/or account within any consecutive 90-day period. This limit applies to all new and used product (including pre-sales and pre-orders) and any combination of those groups.
This purchase limit is in addition to all previously communicated same title purchase limits, both daily and cumulative, and applies to all new or used promotional offers for DVD, Blu-ray and game product; including but not limited to pre-sale/pre-order promotions, bundle promotions (e.g., 3 Previously Viewed DVDs for $20), percent off promotions (e.g., 25% Off All Pre-Owned Games), discounted contingent pricing (e.g., buy named title and receive choice of select set of titles for a discounted price) and "Buy One/Two, Get One/Two Free" offers.
Where applicable, BLOCKBUSTER accepts most titles, except movies rated X or NC-17, or AO-rated games. Trades of any otherwise acceptable title are limited to two (2) per day of the same title and game software platform. Games and hardware not traded in all stores.
Trade offer is for personal use only and is not available to other retailers, dealers, or wholesalers. In order to enforce the foregoing, BLOCKBUSTER reserves the right to limit total quantities traded per BLOCKBUSTER Membership account in our sole discretion, without prior notice.
BLOCKBUSTER strictly enforces applicable state and local laws, including any restrictions on accepting trades from or sales to minors, and requirements for government-issued photo I.D. Certain state/local laws may require disclosure by us to designated law enforcement agencies of transactions, including personal information. All trade transactions are final upon completion and subject to the Trading Authorization and Trading Terms and Conditions.
If a customer receives a printed or advertised price from another local store greater than the price offered at BLOCKBUSTER for the same item (version, format, rating, year, edition- DVD, Blu-ray and select game platforms only, excluded VHS), we want to know about it. BLOCKBUSTER will gladly match their price and beat it by 10% with valuable BLOCKBUSTER store credit at the time of trade or within 14 days of your trade. Competitor's price must be an everyday offer (special offers or promotions are not applicable) for same item in acceptable trade condition and must be presented to BLOCKBUSTER along with the item, a dated printed quote or advertisement from our competitor (original only, reproductions are not accepted). Customer must provide their dated receipt from BLOCKBUSTER within 14 days to trade to receive this offer.
Our policy applies only to a competitor's printed or advertised everyday prices. Our policy excludes internet offers. It does not apply to special offers or promotions, including rebates or bundle offers or misprinted advertisements. BLOCKBUSTER reserves the right to limit quantities. Available only on items BLOCKBUSTER considers for trading. Participating BLOCKBUSTER stores only. Policy is subject to applicable laws and to change without notice. Regular trading terms and conditions apply. All trades are final and cannot be reversed.
BLOCKBUSTER will refund your purchase of any new merchandise appearing in its unopened original packaging returned within 30 days. Your original receipt is required for all returns and exchanges. All returns and exchanges must be in original condition and include all accessories.
Non-returnable items include (without limitation) consumable items such as food and drink, BLOCKBUSTER GiftCards®, third party gift cards, pre-paid cards or other types of third party cards and items that are damaged or abused.
Game hardware and accessories, cameras, consumer electronics and demo products that have been opened are eligible for a refund if returned within 14 days of purchase in their original packaging with all components and manuals. After 14 days, these items can only be exchanged for an identical item within 30 days of purchase, provided you have the original receipt and only at the original store of purchase. Opened movies, games and music cannot be returned for a refund but can be exchanged for the identical item within 30 days of purchase, provided you have the original receipt and only at the original store of purchase.
An in-store merchandise credit will be given if the identical item is unavailable for any of the electronics and media products listed above (and any other similar products that BLOCKBUSTER may sell from time to time).
Notwithstanding the foregoing, BLOCKBUSTER will refund the purchase price of any electronics or new or open media items (i.e., movies, games and music) that are defective or mislabeled that are returned within 30 days, provided you have the original receipt. If you do not have the original receipt, or if the 30-day period following the original purchase date has expired, any defective or mislabeled movies or games must be returned directly to the manufacturer.
Any refunds will be in the same form as the original purchase. For example, refunds for purchases made with a credit or check card will be credited back to the same card. Refunds for purchases made by check or cash will be given in cash. Cash refunds that exceed $500 will be credited back to either a credit or check card if cash balance is not available at the store. Please allow 7 business days to process refunds for payment made by check. Refunds for purchases made with a BLOCKBUSTER GiftCard or BLOCKBUSTER ValueCard will be credited to the same card or to a new card.
This Refund and Return Policy is not applicable to products/services specifically marked with a different return policy in the sole discretion of Blockbuster LLC and products/services purchased online through BLOCKBUSTER MOBILE. Additionally, items purchased through www.blockbuster.com and mobilestore.blockbuster.com may not be returned to a BLOCKBUSTER store.
Members wishing to have three or more games checked out at a time must secure their account with a valid major credit card or check card, which may be charged as authorized in the membership agreement. In addition, Members wishing to rent XBOX 360®, PLAYSTATION 3®, or WiiTM, PlayStation® Move, or XBOX 360® KINECT games must secure their account with a valid major credit card or check card, which may be charged as authorized in the membership agreement. Blockbuster does not accept debit cards or pre-paid credit cards as security on member accounts. Blockbuster reserves the right to limit the number of games a member may rent in any transaction and/or have outstanding at any time, and to refuse to allow additional rentals (movies or games) on any accounts which exceed these limits.

BLOCKBUSTER'S policy is to refuse rental or sale of "R" rated movies, "M" rated games or other product designated as restricted, to youths under the age of 17 unless parental consent is given. You may elect during membership sign up or by asking one of our Customer Service Representatives to allow youths listed on your account to rent or purchase restricted product.

GiftCards purchased before 11/06/07: BLOCKBUSTER GiftCards® ("GiftCards") and ValueCards bought before 11/06/07 will expire after 24 consecutive months of non-use, except that expiration is void for GiftCards and ValueCards sold in AR, CA, CT, HI, KS, LA, MA, MD, ME, MN, MT, ND, NE, NH, NJ, NM, NV, OK, RI, VT, WA and where prohibited by law.
GiftCards purchased on or after 11/06/07: GiftCards and ValueCards purchased on or after 11/06/07 are not subject to any service fees or expiration dates. This policy supersedes any contrary language on the back of the GiftCard or ValueCard (purchased on or after 11/06/07) stating that there may be an expiration date. All other Terms and Conditions of the GiftCards and ValueCards purchased on or after 11/06/07, including those listed here, remain in effect.

Blockbuster LLC is committed to making reasonable modifications in policies, practices, and procedures to permit the use of service animals in its stores by persons with disabilities. Service animals play an important role in ensuring the independence of people with disabilities, and it is therefore our policy to welcome into our stores and business offices any animal that is individually trained to assist a person with a disability.
What is a Service Animal?
Service animals are individually trained to work or perform tasks for individuals with disabilities. Service animals are not always dogs; other animals may assist people with disabilities. Service animals come in all breeds and sizes, may be trained either by an organization or by an individual with a disability, and need not be certified or licensed. Service animals do not always have a harness, sign, or symbol indicating that they are service animals. A service animal is not a pet.

Requirements Regarding Service Animals:
Most of the time, people with disabilities, who use service animals, may be easily identified without any need for questioning. If we can tell by looking, do not make an individual feel unwelcome by asking questions. However, if we are unsure whether an animal meets the definition of a service animal, it is Blockbuster's policy to ask the individual only one question at the point when the individual seeks entry to the store or office:
If the individual says yes or otherwise explains that the animal is required because of a disability, Blockbuster will welcome the person and service animal into the store or office. Once an individual with a service animal has answered that one question, we will not ask any further questions about his or her service animal. Blockbuster will not ask an individual any questions about his or her disability or ask an individual to show a license, certification, or special ID card as proof of their animal's training.
If other customers complain about the presence of a service animal, explain to them that federal law protects the right of the person to be accompanied by service animals in public places. Blockbuster will permit service animals to accompany individuals with disabilities to all areas of our stores normally used by customers or other members of the public and will treat individuals with service animals with the same courtesy and respect that it affords to all of our customers and to other members of the public who visit our stores or offices. Thus, Blockbuster will not interfere with the important work performed by a service animal by talking to, petting, or otherwise initiating contact with a service animal.
Manager Responsibilities
In the event that a particular service animal's vicious behavior poses a direct threat to the health or safety of others, Blockbuster has the right to exclude that animal from our store or office at that time. Barking alone is not a direct threat. In addition, a direct threat does not exist if the service animal's owner takes prompt, effective action to control the animal
Only Store Managers, with the approval of their Regional Sales Manager or Human Resources Manager, can make the decision to exclude a service animal because it poses a direct threat. We will not exclude a particular service animal based on past experiences with other animals, or based on fear that is not related to an individual service animal's actual behavior. Each situation will be considered individually. In the event Blockbuster excludes a service animal because of a direct threat, the individual with a disability will still be welcome in our stores when he or she is not accompanied by that particular service animal.
