Membership and Use
You must be a BLOCKBUSTER member to purchase a Pass. The Pass membership you purchase is your "Pass Membership" and your regular BLOCKBUSTER membership is your "account" or your "BLOCKBUSTER account." For a monthly Pass Membership fee (plus applicable taxes), you can rent up to a certain number of games at any one time (as explained below). The amount of the Pass Membership fee will vary depending on the number of rentals you select when you purchase the Pass Membership, and may also be different from store to store and may be changed from time to time. Your Pass Membership can only be used at the participating BLOCKBUSTER store where you purchased the Pass Membership. Your Pass Membership can only be used on one BLOCKBUSTER account, and is nontransferable. Your Pass Membership starts on the day you buy it, and automatically renews every month (as explained below) until you cancel or until we can no longer charge the monthly Pass Membership fee to the credit card or check card* (the "Payment Card") you've given us (the "Pass Membership Term"). By using your Pass Membership, you acknowledge that we've given you a copy of these Terms and Conditions and that you've read and agree to them.

The Pass Membership you purchase allows you to rent up to a predetermined number of games on your Pass Membership, for no additional charge other than your monthly Pass Membership fee, so long as the game rentals are returned to the store location where they were rented before the expiration of the Pass Membership Term. The games you rent on your Pass Membership are your "Pass Rentals." The number of Pass Rentals you can have out at any time depends on the Pass Membership you buy-for example, your store may offer an option to have out one, two, or three games at a time, or something else. The available options may vary from store to store and from time to time. The maximum number of Pass Rentals you can have out at any one time is your "Maximum Pass Rentals."

To rent a Pass Rental, you must present your BLOCKBUSTER membership card or your government-issued photo ID at the time of rental. You may only rent one (1) copy per title as part of your Pass Rentals. Your Pass Rentals do not count as paid rentals towards BLOCKBUSTER Rewards® benefits. You can use your Pass Membership to rent any games in the store, but you can't use your Pass Membership to rent movies, special products such as defensive driving courses, or equipment. Once you've reached your Maximum Pass Rentals checked out at any time, no additional games may be designated as Pass Rentals until you return one or more of the Pass Rentals. You may rent as many additional games as you like, but these additional rentals will be subject to the otherwise applicable rental terms (i.e., due dates and times) and membership rules then in effect for the store from which the games were rented (the "Rental Terms"). These additional rentals also will be subject to all otherwise applicable rental fees and other charges (including extended viewing fees (where applicable), additional daily rental fees (where applicable) and charges for games not returned by a specified date and time, the rental of which are converted to a sale) (we'll refer to all of those possible fees and charges as the "Fees"). If you are renting Pass Rentals and other games rentals in the same transaction, you must designate which game rentals you want to be the Pass Rentals at the time of rental, and you may not change your designation once the transaction is completed. Pass Rentals will be identified as such on your rental receipt.

You may purchase different levels of Pass Membership at one time. For example, you may have a one-game Pass Membership and a two-game Pass Membership, if available at your store. However, you can only have one of each level of Pass Membership at any time (for example, you can only have one two-game Pass Membership at any given time). If you have multiple rental passes on your BLOCKBUSTER account (for example, if you have more than one Pass Membership, or another type of pass such as a BLOCKBUSTER Flip Card™ that you purchased prior to purchasing your Pass Membership), Blockbuster will determine in its sole discretion to which pass the rentals apply. Also, Pass Rentals are specific to the particular Pass Membership and can't be combined, even if you have multiple Pass Memberships.

The rental period for Pass Rentals is the Pass Membership Term for that Pass Membership remaining as of the date of rental. Any Pass Rental not returned by the expiration date of the Pass Membership Term will immediately be subject to the Rental Terms and applicable Fees upon the expiration of the Pass Membership Term. Remember, you can't combine Pass Rentals on different Pass Memberships. If you have multiple types of Pass Memberships, and one expires while another is still valid, you still must return any Pass Rentals associated with the expiring Pass Membership prior to its expiration or those rentals will be subject to the Rental Terms and applicable Fees, even if you've got less than the Maximum Pass Rentals checked out under your non-expiring Pass Membership. The only instance in which Pass Rentals will automatically transfer to another Pass Membership is if you are upgrading or downgrading your Pass Membership as discussed below AND if there is no lapse in Pass Membership Terms between the two Pass Memberships.

Pass Rentals may not be used for payment of any other account balance, including any applicable Fees. This offer and Pass Rentals are not valid with any other discounts or offers.

How to Buy, Monthly Charge Authorization, Cancellation by Member, and Upgrading/Downgrading
How to buy a Pass Membership- Automatic Monthly Renewal by Credit Card or Check Card Payment: At the time you pay the applicable initial Pass Membership fee (plus applicable taxes) for the first month's Pass Membership, you are agreeing and directing Blockbuster or its agent to automatically renew your Pass Membership each month for the applicable membership fee (plus taxes) by charging your Payment Card until your Pass Membership is canceled as provided herein. To do so, you must provide to Blockbuster your Payment Card charge authorization information for the Payment Card that you provide for payment of the monthly Pass Membership fee. You agree to pay the applicable monthly Pass Membership fees (plus applicable taxes) in accordance with your Payment Card issuer agreement. From time to time, Blockbuster may offer a discount on the initial Pass Membership fee for a specified promotional period. You agree that any such discount is only valid for the specified promotional period, and that the regular applicable monthly Pass Membership fee will be charged to your Payment Card for each automatic renewal.

Monthly Charge Authorization
By requesting a Pass Membership and by accepting the benefits of the Pass Membership, you agree that as a condition of your continued Pass Membership you authorize Blockbuster or its agent to charge the applicable monthly Pass Membership fee (plus applicable taxes) to the Payment Card on the monthly anniversary date of purchase for each consecutive month of Pass Membership until your Pass Membership is canceled. This continuing charge authorization shall be equivalent to individual signatures by the member on subsequent monthly Payment Card charges or "signature on file" transactions. You will not be provided with copies of charge slips evidencing the recurring charges of the applicable monthly membership fee. You also agree that the amount of applicable taxes may change from time to time, and you authorize any such changed amount to be included in your recurring monthly charge for your Pass Membership.

Disclosure to and Electronic Fund Transfer Authorization by Check Card Holders
Check cards are a form of debit card which cause charges against bank accounts and are subject to federal law. If the Payment Card you have provided is a check card, in order to request Blockbuster to extend your Pass Membership Term month to month you must authorize Blockbuster or its agent to charge the check card monthly and therefore to effect preauthorized transfers from the bank account that is associated with your check card. Your request to pay your recurring monthly Pass Membership fee (plus applicable taxes) with preauthorized charges to your check card and your written or electronic execution of an acknowledgement of your receipt of these terms and conditions constitutes your preauthorized electronic fund transfer authorization for future charges on your check card and your assent to these terms and conditions. You may cancel your Pass Membership at the BLOCKBUSTER store (identified above) where you bought the Pass Membership. This cancellation will cancel any check card charge authorization that was to occur on any day after the date of cancellation. No refunds will be made for Pass Membership fees already paid or charged. You may also cancel your preauthorized charge authorization by contacting your bank within a sufficient time to cancel the authorization (see your agreement with your bank for the terms and conditions of cancellation), but cancellation of your authorization with your bank will not serve as notice to Blockbuster concerning cancellation of your Pass Membership.

Expiration of Payment Card or Other Refusal of Charges
If the Payment Card is no longer valid, has expired, or for any reason will not accept charges for subsequent monthly Pass Membership fees, you have a period of 10 days from the date that your Payment Card was declined to visit the participating store where you purchased your Pass Membership and provide new valid Payment Card information. If new valid Payment Card information is provided within the 10-day period and any past due Pass Membership fees are paid, then Pass Membership benefits will continue uninterrupted and this new Payment Card will be used to charge the applicable monthly Pass Membership fee for each consecutive month until your Pass Membership is canceled (your original anniversary date will still apply). If you do not provide new valid Payment Card information within the 10-day period, then your Pass Membership will expire on either the 11th day from the date your Payment Card was declined or the last day through which your Pass Membership was paid, whichever occurs later.

Cancellation by You
The initial monthly Pass Membership fee is valid for an initial Pass Membership period starting on the date of purchase and continuing through the same day of the following month. For example, if on June 18 you purchased your Pass Membership, your initial Pass Membership fee entitles you to Pass Membership benefits until July 18 and your Payment Card will be charged on July 18 for the period of July 19 through August 18. You can cancel your Pass Membership at any time at the participating store where you bought your Pass Membership and you will not be charged for any additional months. There are no refunds for any months (or portions thereof) already billed or paid for. For example, if your purchase anniversary date is the 5th of each month and you cancel your Pass Membership on Oct. 20, then you will not be charged on Nov. 5 (for the Nov. 6 - Dec. 5 period) and your Pass Membership Term will expire on Nov. 5. However, if you canceled on Oct. 2, then your Pass Membership Term would expire Oct. 5. Remember, you must return any Pass Rentals rented under your Pass Membership by the end of your Pass Membership Term (or they will be subject to the Rental Terms and applicable Fees as provided above). You agree that the Pass Membership does not involve an extension of credit or a retail installment sale since Blockbuster does not impose a finance charge and you may cancel your Pass Membership at any time.

Pass Rentals At Time of Cancellation or Expiration
Pass Rentals that are not returned prior to the expiration or cancellation of the applicable Pass Membership Term will immediately be subject to the Rental Terms and applicable Fees upon the expiration of the Pass Membership Term (unless you are upgrading or downgrading, as noted below). See your store for applicable Rental Terms and Fees.

Upgrading and Downgrading of Pass Memberships after initial trial period
If the store where you bought your Pass Membership offers more than one level of Pass Membership, you may upgrade or downgrade your Pass Membership after your initial trail period if there will be no lapse in Membership Term between the two Passes. The effective date of the upgrade or downgrade will begin on the next applicable anniversary date following the submission of the upgrade or downgrade request. To upgrade or downgrade your Pass Membership, visit the store where you bought your Pass Membership and ask to upgrade/downgrade your Pass Membership. You will be asked to give your written or electronic authorization to the new recurring monthly charge and pay the applicable monthly Pass Membership fee for your new upgraded or downgraded Pass Membership for the initial month. By upgrading or downgrading your Pass Membership, you are agreeing and directing Blockbuster or its agent to automatically renew your new upgraded or downgraded Pass Membership each month for the applicable Pass Membership fee (plus taxes) by charging your Payment Card until your upgraded/downgraded Pass Membership is canceled as provided herein. Your monthly anniversary date will remain the same; on your next monthly anniversary date, your old Pass Membership will expire and your new upgraded/downgraded Pass Membership, and new amount of Maximum Pass Rentals, will begin. In addition, when you upgrade or downgrade your Pass Membership, any outstanding Pass Rentals rented on your Pass Membership will automatically transfer to your new upgraded or downgraded Pass Membership, as long as there is no lapse in Membership Terms between the two Pass Memberships. If you've downgraded, you must return any Pass Rentals that would exceed the new number of Maximum Pass Rentals before the effective date of your new downgraded Pass Membership. For example, if you downgrade from a two-game Pass Membership to a one-game Pass Membership, and you have two Pass Rentals checked out, you must return one Pass Rental before the effective date of your downgrade (which would be your normal monthly anniversary date). If you don't, one Pass Rental will immediately be subject to the Rental Terms and applicable Fees upon the effective date of your downgraded Pass Membership. Blockbuster will determine in its sole discretion which unreturned Pass Rental will no longer be considered a Pass Rental and will be subject to the Rental Terms and applicable Fees. If you've upgraded, you can add additional Pass Rentals as of the effective date of your upgrade (which would be your normal anniversary date). For example, if you upgrade from a one-game Pass Membership to a two-game Pass Membership, and you have one Pass Rental checked out, you may check out one additional Pass Rentals on the effective date of your upgrade.

Cancellation or Changes to Pass Membership by Blockbuster
Subject to the next sentence, Blockbuster may change any or all aspects of Pass Membership, including the monthly Pass Membership fee, the number or composition of permitted Pass Rentals, the name of the Pass Membership, the applicable Pass Membership rules and regulations and special offers regarding the Pass Membership, and any other term or condition applicable to Pass Membership, at any time, and from time to time, without prior notice. However, Blockbuster will give prior notice at participating BLOCKBUSTER store locations of any change to the Pass Membership fee or price or the number or composition of permitted Pass Rentals that will adversely affect existing Pass members. You agree that, unless you cancel your Pass Membership prior to the effective date of the change, you will be charged the new applicable monthly Pass Membership fee each subsequent month on and after the effective date of such change. Blockbuster reserves the right to end the Pass (including, without limitation, ceasing to offer one or more of the types of Passes) with 30 days prior notice at participating BLOCKBUSTER store locations. This is a limited time in-store offer and is available only at participating BLOCKBUSTER store locations. Void where prohibited.
